Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the PEMRIA mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and Nest Productions (“Company,” “we,” “our,” or “us”).

2. Eligibility

PEMRIA is intended for users age 11 and older. Users under the age of 13 should have verifiable parental or guardian consent/awareness before creating an account. By creating an account, you represent that you meet these age requirements. We reserve the right to terminate accounts that do not meet eligibility requirements.

3. Account Registration

To use PEMRIA, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@pemria.com if you suspect unauthorized access to your account.

4. Subscription and Billing

PEMRIA offers the following subscription tiers:

Free Tier: Available to all users at no cost. Users aged 80 and older are automatically converted to the Free tier.
Charter Member: $10/month or $120/year, available to users who subscribe before October 1, 2026. This rate is locked permanently and will be restored upon resubscription using the same email address, even after cancellation.
Standard: $14/month or $144/year.

All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time through the App under Settings → Subscription. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.

5. Acceptable Use

You agree to use PEMRIA only for lawful purposes and in accordance with these Terms. You agree not to:

Use the App in any way that violates applicable laws or regulations
Attempt to gain unauthorized access to any part of the App or its related systems
Upload or transmit harmful, offensive, or misleading content
Use the App to collect data about other users without their consent
Attempt to reverse engineer, decompile, or disassemble any part of the App

6. Health Disclaimer

PEMRIA provides general wellness information and educational content only. The App is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of content you have read or accessed through PEMRIA.

7. Privacy

Your use of PEMRIA is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at https://pemria.com/privacy-policy.

8. Intellectual Property

All content, features, and functionality of PEMRIA — including but not limited to text, graphics, logos, icons, images, and software — are the exclusive property of Nest Productions and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

9. Limitation of Liability

To the fullest extent permitted by law, Nest Productions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Nest Productions and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the App or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we determine that you have violated these Terms or that your use of the App poses a risk to other users or to the integrity of the platform. You may delete your account at any time through the App settings.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by email. Your continued use of PEMRIA after changes are posted constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in New York County, New York.
